Mexicana lost luggage refund
In what I hope is the final installment of the Mexicana series, Jaime finally comes through. I think you’ll enjoy the following letter that accompanied my check (make especially sure you read the third paragraph):
Dear Mr. YankeeTag:
This will acknowledge receipt of your letter wherein you informed us about lost of your baggage with MEXICANA flight connection MX307 route: Mexico - Cancun, in October 02, 2007.
In regard to your delay luggage compensation request, enclosed find our check number XXXXXX with charge to the JPMorgan Chase Bank, in the amount of $540.00 USCY (five hundred forty 00/100USCY) as full and final settlement for your claim.
Please be informed that your claim has been adjusted in accordance with regulations Governing International Travel. These regulations, which are part of the Conditions of Contract outlined on each ticket and contained in the provisions on the Warsaw Convention.
Please accept our sincere apologies for the inconvenience you reported. We hope that you will give us another opportunity to prove we can serve you in a completely satisfactory manner.

Aside from the irritation that they can’t find anyone to even proofread the form letter they routinely send out, this letter is a little insulting.
First, it shouldn’t take from October 2, 2007 to February 14, 2008 to rectify the fact that some minimum wage employee (do they even have a minimum wage in Mexico?) looted my belongings.
Second, they called it my “delay luggage compensation request”. I guess we’ll have to chalk this one up to a translation error. See, in real English, ‘delayed’ means it came later than expected. I think the word they were looking for is ‘extremely reasonable lost’ (In context: “your [extremely reasonable lost] luggage compensation request”).
Finally, I don’t know which I find more offensive: a) that lost airline baggage was a topic at the WARSAW CONVENTION, or b) that this was handled in accordance with the regulations they decided on there.

As to international transportation, by Presidential Proclamation, the United States adheres to the “Warsaw Convention” which provides that an air carrier’s liability for a negligent act causing personal injury to one of its passengers, is limited to 125,000 francs (approximately $8,300) for each passenger. If the air carrier is guilty of “willful misconduct” or if a special contract has been entered into, such limitation will not apply. The Warsaw Convention requires the injured party to bring a lawsuit within two years of the accident or the action will be dismissed. Also, the air carrier will not be liable if the carrier can prove that due care was used. This Act applies to injuries sustained on the plane or while embarking or disembarking from an international flight.
Ok, what about when people start going to the moon regularly? Shall we start a petition to get some sort of inter-galactic agreeement about lost-space-luggage?

hi , i flew with mexicana on sat, june 21st with my 6 month old daughter, and they lost my baggage. they will not do anything to help me at all. they took my baggage tags in the airport, max alicia, milly , carolina gamboa, and gustavo, the incompitant retards in calgary airport screwed me with a smile. they made me wait 2 hours to fill out this form and didnt fill in the 10 digit ref. number. i returned the following night with my baby in hand freezing, and they didnt give me any answers on all of our belonings. we are moving here from mexico, im canadian, but this is all we have, really. gone. i have phoned each day to locate my belongings, and they pass me around the office like a ##$#$%#%. can anyone tell me what to do, i cant afford a lawyer, and i am a young mom, if yiou have any suggestions email me. desperatly cold in great canada, jennifer and little luana :-p
Hi Jennifer - the same story happened to me last week. I arrived from Guatemala, via Mexico, at Calgary airport to attend a wedding and my baggage wasn´t there. It actually was found in the end, but arrived three days later - fortunately just the day before the wedding. The suitcase was soaked and one of my evening dresses was completely destroyed as the colours had run in to each other….
No apologies from the staff (except Max, who actually delivered the suitcase to Cochrane himself as the delivery boy never arrived..) and Gustavo Suarez, the manager, who had iniitally told me that I had a right to a 100 Dollar compensation (haha) if my luggage hadn´t arrived after 48 hours (on the night of my arrival it was 24 hours, when I called the next day it had moved up to 48 hours), then explained that the 48 hour window only referred to the time the suitcase had to arrive at the airport. Meaning, that I apparently dont have a right to claim the compensation since they received the luggage onthe 2nd evening - although they didn´t get it to my hotel until about 16 hours later!!!!!!!
I spent about 70 dollars on some essential clothes and cosmetics to get me through those 3 days, and I absolutely dont accept that I cannot get any compensation for this. I have no idea what legal possibilities there are, there must be some kind of aviation ombudsman which we could try and contact. My first step will be to write a letter to the main office in Mexico and see what they come up with.

We flew the last leg of our journey on Mexicana. We did not receive our daughter’s car seat (in addition to all the other checked-in luggage). The fact that it was lost was not their fault, but they did little to help us in replacing the car seat so we could get home. We were stranded at the airport after a 30 hrs on the planes and three connections. What is worse is that they never answer the phones. We ended up buying a new car seat.
I too fell victim to the Mexicana airlines when they lost my luggage. I just arrived from visiting Guadalajara city in Mexico and upon returing my luggage was not to be seen. I filed a lost claim report and was contacted a day later by Mexicana that they located my bag in Mexico city! I finally had it delivered only to find that my bag had missing items! My camera and memory cards along with my battery charger were gone! Mexicana gave me the run around when I contacted them to report the theft. I advise anyone to avoid Mexicana airline or from traveling into Mexico for that matter.
